Sanvo Resorts Pvt Ltd (“Developer”) is developing the Project known as Marathon Nexzone at Panvel in various phases. These Terms and Conditions ("Terms") govern your engagement with the Developer and the submission of your Expression of Interest (EOI) for the Project namely “Marathon Nexzone- Phase-3 at Panvel”. By submitting an EOI and making a payment, you agree to the following Terms:
1. General Terms
- 1.1. A person who is competent to contract under the Indian Contract Act, 1881 is eligible to fill in/submit the EOI.
- 1.2. By submitting the EOI, you merely indicate your interest in purchasing a unit at Marathon Nexzone Phase-3.
- 1.3. Submission of an EOI does not constitute a confirmed booking or allotment of any unit in the Project.
- 1.4. All details and offers are subject to the discretion of the developer and may be changed without prior notice.
2. KYC and Compliance
- 2.1. The EOI submission is subject to the successful completion of Know Your Customer (KYC) verification as per applicable laws.
- 2.2. Customers are required to provide valid identification documents, including PAN card, Aadhar card, and proof of address, for verification purposes.
- 2.3. The registered email ID and contact number should be your own.
- 2.4. The developer reserves the right to cancel the EOI if KYC verification fails or is not completed within the specified timeline.
3. Payment Terms
- 3.1. Payments should be made from your own bank account via approved methods, including online payment gateways, cheques, or demand drafts.
- 3.2. Customers must ensure sufficient funds in their accounts to avoid payment failure or dishonor.
- 3.3. Payments made through Razorpay or other online platforms will comply with the respective payment processor's terms and conditions.
4. Shipping and Delivery of Documents
- 4.1. Upon receipt of the EOI and payment, an acknowledgment receipt will be shared with the customer via registered email and/or WhatsApp.
- 4.2. Physical documents, if any, will be delivered to the customer's registered address via courier or other appropriate delivery methods.
- 4.3. The company is not liable for delays in document delivery due to courier issues or incorrect address details provided by the customer.
5. Acceptance
- EOI will be accepted within a period of ____ days from _______ (subject to any changes).
- If EOI is accepted, and if the customer intends to book the unit, then the customer shall fill in the Reservation form within __ days from __________, accompanied with Earnest money failing which the unit shall be allotted to another customer.
- Allotment, if made, will be upon terms and conditions in the Reservation form.
6. Cancellation and Refund
- 6.1. The EOI payment amount is fully refundable in the event of withdrawal, cancellation, or non-allotment of your preferred unit.
- 6.2. Cancellations must be submitted via your registered email or in writing to our sales team.
- 6.3. Refunds for canceled EOIs will be processed within 7-14 business days from the date of approval of the cancellation request.
- 6.4. In case of refund delays due to unforeseen circumstances, the company will communicate the revised timeline to the customer.
- 6.5. In case it is found that the applicant has misrepresented any fact or information in this EOI or in financial instruments/KYC documents, such application shall be summarily rejected.
- 6.6. In the event of withdrawal/cancellation/rejection, the Developer shall be entitled to deal with and/or dispose of the Unit in a manner it deems fit and proper, and the Applicant shall not make any claim or raise any objection in this regard.
7. Disclaimer
- 7.1. The EOI process and related communications are not an offer to sell but an invitation to express interest in the project.
- 7.2. The Applicant irrevocably confirms that by submission of the EOI form, he/she merely expresses his/her preference of interest in the available units and does not apply for Allotment or Agreement for Sale.
- 7.3. The developer reserves the right to accept or reject any EOI at its sole discretion.
- 7.4. This EOI form shall be governed and construed in accordance with the laws of India. All disputes are subject to jurisdiction in the courts of Panvel/Mumbai.
